I just did this. There are two parts, the one you got the 1099 for and the disability. It sounds like you know what to do with the 1099. The state disability you were paid is taxable at the Federal level.
Does anyone know what the proper course is for filing your taxes when you took maternity leave and child bonding during that tax year? Is it considered disability or unemployment?

Thanks Mamas! My friend who I was asking the question for, did indeed get one 1099 form for the FMLA baby bonding time, so from what I'm gathering from most responses; this income is taxable and considered disability!

I just want to reiterate what others have said--if you took Family Leave Act money, it IS taxable, and you SHOULD have received a form, indeed.
I was a teacher and used my sick leave for the duration of my 6 week maternity leave; my Family Leave was unpaid except for benefits, which were not taxed anyway, so I filed normally. If your situation is different than just using your sick time, I think the IRS hotline can answer your question (and it is free). Good luck.
the first part of the leave (up to 4 weeks before & 6/8 weeks after usually, but dependent upon what you doctor says) is disability and is not taxable. the fmla is non-taxable in california, but taxable on your federal forms. you should receive the paperwork for all of this from the state.
I know I am a little late responding, but I had the same situation this year.. the 4 weeks before and 6-8 weeks after is state disability and is not taxed. The Paid Family Leave you get for 6 weeks after that is not taxed at the time you get it, but you will be taxed for it when you file your taxes and add it as additional income (that's why you get the 1099 but if u calculate, it is only for the time you received Paid Family Leave).
Just had to deal with the taxes thing. You should have gotten a 1099 from disability- the first part of your leave when you are on medical disability- (4 weeks before, 6-8 weeks post) is not taxable, but the bonding time is taxable hence why you should have gotten a tax form.
When I had my last baby in September 2007 I was able to use disability when filing my taxes.

I'm assuming you collected the California State Disability, 4 weeks before, 6-8 weeks after then 6 weeks bonding time? That's disability, not unemployment. I could be wrong, but I don't think you have to claim the money...but that was last year for me and I've lost my mind =O)
I didn't claim anything on my taxes either. I even went on early maternity leave (pre-term labor) and was told by my tax acct. I didn't have to claim anything for disability. But that was 7 years ago.

Paid Family Leave ( for bonding time) compensation is taxable, and you should have received a form 1099G from the EDD department. You can call ____@____.com , if you have not received the same.
I had taken paid family leave in 2008, and I received this form from EDD.

It's disability, and only the 6 weeks bonding through FMLA is taxable. As has been said before, you should have gotten a 1099 for the 6 weeks' bonding. I just wanted to reiterate that, as someone who took maternity/bonding leave last year and just filed my taxes, as well as a tax attorney! :)
Bottom line - the first 6 weeks are considered Maternity leave and paid by state disablitity, which is NOT taxed. The next 6 weeks, bonding w/baby, is considered FMLA (family leave) and is taxable, but you will get a 1099 by Jan 31, 2010 to document it on your 2009 taxes.

It is disability insurance and I didn't have to claim it on any of my taxes. If you go to the EDD website you can find where it says you don't claim it.
