Protecting My Daughter

I was required by a judge to let my daughter go with her daughter after 3 years of supervised visits agreed between the two of us. I pleaded with the judge about the sexual accusations my daughter made. The judge went against me because of his relationship with my ex husbands lawyer. However, my daughter went to her counselor and told them that her father did it again. CPS was notified and the report is being substantiated. However, they are telling me that my ex husband can still take me to court for keeping her from him. I am worried about the judge. What can I do to protect my daughter she is only 6 1/2 years old. Can CPS not do anything further?

Your ex can take you to court, but that doesn't mean he'll win. Seems to me that if you have a substantiated report from CPS that these things are going on, then CPS should be insisting that the visits terminate or at least go back to supervised visits. Call CPS and find out what they intend to do. It is their job to protect your child!

The laws are different in every state.

If you don't have a lawyer, you need to get one right away. If you do have a lawyer, you need to be sure that he/she knows everything that is going on. If your lawyer isn't being aggressive enough , get a new one. If the judge is not being impartial your lawyer needs to ask that he recuse himself so that you can get an impartial judge.

It's time for a serious talk with your lawyer.

I'm sorry, I can't answer your question although this must be heartwrenching for you. I hope you have your own lawyer, because you should be asking that person these questions.

What a horrible situation. The only advice I can give is to go to the police with all of your documented evidence. I assume you have a lawyer already.
