In the Middle of Divorce Self Employed Spouse Hiding Money

I just found out that my to be EX is having his customers that pay with check make out to cash instead of to the name of the business. What should I do? Since the divorce started he has managed to cut the earning that were in his business account to half I know he is hiding money. I am desperate since what he is giving me for my 2 daughters is not enough. I don't know what to do. HELP PLZ!!

So What Happened?

Well this divorce has been running now for a year. I had to fire my first lawyer because in one of my last court dates it seemed she was paid off by my soon to be EX. He was owing her for fee's and wasnt paying suddenly the day I had court she was a no show and not even responding to my calls or messages that morning. When my new attorney sent her the release papers she sent me an email demanding monies owed. When I responded that I wanted an itemized bill but to also to deduct the no contact for 2 months in between the year she did this on and off she never replied something is pushing me to think he paid her off to delay paperwork. I think he is paying alot of people of and yes his bank account went from $40k a month to $20k a month and from hersay only I am hearing he will want to make everyone think he is going bankrupt my new attorney is trying to egt things in to gear but its hard. I feel kinda lost. The checks to "CASH" seem to be some hope but I informed my attorney last week and I have not received a call from him either I feel LOST.

A judge will see right thru this type of scam. It's great that his customers are still writing checks even if they are made out to cash. As long as they are writing checks there is documentation to prove that they were past clients writing checks to the business & suddenly since the divorce proceedings the clients are making the checks out to cash. The clients can be subpoena too. Depending on what kind of business it is maybe there are some type of receipt log or something to show services were performed or distributed. Also depending how long the divorce has been going on if his business income took a nose dive like you say then it won't be hard to figure it out!

Call your lawyer. That's what lawyers are for. He or she will know how to investigate this and whom to notify. This isn't the first time this situation has ever happened.

However you came upon this information needs to be documented and passed on to your lawyer ASAP! If you know because someone told you, have that person contact your lawyer to provide a written statement and/or proof that that is what is happening.

Bring it up to your lawyer RIGHT away.
When my parents were getting divorced my dad was hoarding money away. I Found out about it and made DAMN sure my mom & her lawyer and etc had the proof they needed to show he had WAY, WAY more money than he made them think.

Contact your lawyer with this information yesterday!! Take as many documenting notes as possible, find proof and corroborating evidence and witnesses (The people who wrote the checks to "cash" for example; with a written and notarized statement of why they wrote the checks differently then previous jobs. Did your soon-to-be ex request this and leave them with a reason, for example. The thicker the paper trail to his office, the better for you.) and present it all to your lawyer. If this is true more than just the IRS and your divorce attorney will find it quite interesting and a serious mark on his character when the judge sees his actions. Good luck and be strong :)

It is sad when this type of thing happens because the kids are the one to suffer. Talk to your lawyer and I think that having the IRS in your court is also a big help because NO ONE gets away from the IRS.
