I know that people will recommend some of the self-help books and will recommend a trust, but please consider talking to an attorney first. A trust is helpful in states where probate is difficult, costly or takes extended time (such as California). In Texas, a trust is not necessary unless you fall into a very high income category and have many real properties that are located in various states/countries. Probate is not expensive in Texas and it does not require an attorney to file a probate matter in Texas. A will is extremely important if you have minor children....if you do not provide for a guardian for your children, do you really want the state deciding where they go?
