I am new to the Frisco area, and my husband and I are discussing divorce. Where do I start, where do I file, can I do it without a lawyer? Help!!!!! I have a 2 year old boy and I'm trying to think of his best interest. Does anyone know of a lawyer in Frisco, that is not expensive. I don't work.

Hi N.,
TO answer your question...if there will be no custody issues, yes you can file without an attorny. My sister did it by using a book to guide her from Barnes and Noble....if you need to know the specific book, etc. contact me and I will get it from her.

One suggestion that helped a friend of mine.....if you haven't already, you may try to go to counseling even if you have filed or are filing. You can't finalize the divorce for 60 days after you file, so if you still want to go forward with it, you haven't wasted any time. In my friends case, they ended up not going through with it and are currently still married and happily so. Just a thought...if nothing else it may provide some closure.

Hello N.,

When you call a lawyer to set up a consultation it should be free. You can ask when you are on the phone with the appointment setter. Once you visit two or three you will have a good idea what is going to be expected. They tell you what papers need to be filed and such. You and your husband will have to be agreed either way to keep the expenses down. To file the papers yourself really is not that hard you can google texas divorce and there are many places to download the forms with step by step instructions. If your husband does not want to go that route - you can still do it yourself - most lawyers (for him) he could have look over the paper work for only about 1K. Or if he hired a lawyer - you can get your own to only look at the paper work for you (you know to make sure it has everything in it you want and lawful) for only 1K.

Since you are a SAHM - you can get alamony but it has to be agreed with your man. Child support runs usually 20% of the income unless a special amount is agreed upon.

But a good place to start is by going to a few lawyers with the free consult - it only takes a bout an hour just to get the info you are looking for - you might find one you like and trust for you future.

Good luck - I am sorry about your situation. It sure is a hard point to come to in your life. Try to be the bigger person for you sons sake - he needs you to be his rock.

My husband and I are recently divorced and have 4 kids. It has been difficult with the custody issues. We thought that there wouldn't be any issues but we ran into some along the way. Although it would be nice to not have to pay a lawyer, be careful... advice alone is worth it sometimes.

the first thing I would do is read the TX family code so you already know exactly what is and is not expected. Some people try to fight for alimony, but it's NEVER an option in TX unless you've been married more than 10 years. Child support and visitation is also cut and dry assuming one parent has primary physical custody and the other has standard visitation. All of this stuff is clearly outlined in the TX family code.
