I posted yesterday and got good responses. I found out one of my co-workers husband also get ssid and extra for their children, I asked her what they do for taxes she said they never had to claim his ssid but has no idea how the taxes would be done if I file on my own. She thought I might no be able to claim hoh but because I am the only one having taxes taken out from my income that I could claim my son, I am hoping I can but I have a sick feeling that I'm stuck for now.

What can I do next?

Go to the source. You really need to ask the right person these questions, any advice you get here is not going to be what you need to hear. Call the SSDI office and ask them, they have whole departments for these type of questions. Or call an accountant.

I understand you want to hear about other peoples experiences but they may have done it wrong and just not been caught yet. It is too easy to get wrong advice and think it's correct. We are just mom's, our life experiences have importance and it's easy to believe what someone writes but they could be just making something up or totally breaking the law and not even know it. They could also be giving you the absolute correct information. It may also be a local law for their area and not yours. A lot of different states have different laws about taxes and stuff. Texas has different laws because of the way they were brought into the United States. Their real estate laws are very different than others. I found that out when I was President for our local Habitat for Humanity Board of Directors. I called a Habitat office in Texas about their methods of home pricing when writing up the papers for the homeowners and she explained that their laws were very different. So, my point is, if someone in Texas was giving me advice on home owners information I might discount it knowing what I do about it. Go to the source for the information you need.

Call the toll free number for the IRS. Ask them the requirements for filing head of household. I don't believe you can file that way.
Call SSI. If they won't talk to you due to HIPAA privacy laws, just ask generic questions about whether or not certain types of disability benefits are taxable.
Next, contact somewhere like H&R Block and see if they can give you some advice.
If you are familiar with your bookkeeper at work, she might be able to help you to an extent without charging you. Or know an accountant who can.
At least as far as just answering some simple questions.
Hopefully you can get some advice to help you make your decisions when tax time comes.

I've always heard you should/can only do married Filing Seperatley if O. of you is MIA or something and there's a big penalty for doing so, so it's rarely a good idea unless you have no other choice.
The main thing seems to be your hubby's out of control spending. Sign him up for a Dave Ramsay workshop or buy him a Dave Ramsay book: Financial Peace or Total Money Makeover. anything else is putting a band aid on the situation. Good luck!

I read your previous post to get a full understanding of your question. You cannot file HOH if you are married. It's either Married-Filing jointly or Married-Filing separately.
You should always ask a tax advisor though, not take the advice of us moms.
