Traffic Ticket?

Has anyone else had an experience fighting a traffic ticket in Harris County? Today on my way home I was extremely suprised to be pulled over. The officer advised me that an unmarked vehicle saw me speeding 70 MPH in a 60 and change lanes without siginaling. I am furious because I did neither of these things and of course the officer that pulled me over is not the one who actually saw me commit the offense.

Anyway I was wondering how the whole process works since I have never had a ticket before, I have no idea what to expect.

So What Happened?

Thank you all for your advice!! I've decided to hire and attorney that apecializes in traffic tickets. From my research it seems that even if I have to pay a reduced fine, it will not go on my driving record and will not affect my insurance. I highly suggest getting an attorney! It's going to greatly reduce my stress level!

That's awful- I should think that is not legal at all. The officer who sees it has to issue the ticket when the offense occurs. I would deffinitely fight it. I didn't know there were traffic lawyers but you might find one or at the very least argue this point with the judge yourself.

I recently got a ticket on hearsay. I was in a bad accident and some people who did not see the accident came and helped me and my girls (ages 1,3,4,5) After the police and ambulances showed up a woman claimed she saw the who thing, she's her brother's keeper, and wants to testify against me! If she saw the whole thing and is her brother's keeper, then why didn't she check to see if we were alright? Why didn't she come to our aid? Our vehicle was UPSIDE DOWN and we couldn't get out without assistance. I don't believe she saw it at all.

Besides, can an officer really give a ticket based on what a civilian says she saw (She said I was speeding, I was not, I was decreasing speed to go around the curve and had mechanical failure PRIOR to the curve and couldn't stop the vehicle and hit a tree.) YEt, they gave me a speeding ticket.

I haven't been able to talk to the judge yet because my ticket hasn't been submitted. They have 10 days in Harris County to submit the ticket and I think it's been past that or pretty close to it. I suggest you wait ten days also, call in and see if they have the ticket processed yet. If they haven't verify that it is a 10 day limit, and ask the clerk's name. Find out if there's something they can give you that says that it's past the ten day period.

If it IS submitted, do talk to the judge about the situation.

My husband consulted a traffic lawyer. The lawyer pushed his court date to a year down the road. After 90 days, the lawyer can go back to the court and say that you've been good for the past 90 days, no tickets, offenses and they wipe the slate clean. It cost him about $150 on top of the ticket, but at least his driving record isn't affected or marked.
I'd take it to the lawyer, cuz the way the officers did it, it's heresay.

The judge will most likely throw that charge out because the ticketing officer was not the one who "caught" you speeding. I think the law will support that. As others have said, it's all heresay, and I don't believe that it will stick. Just to be on the safe side though, I would contact an attorney who handles traffic tickets and is reputable.

They have showed on the news that there are many unmarked vehicles around Houston now that are driving around and alerting police when they see speeders. Supposedly they are just going after excessive speeders. The other day my husband mentioned that he hates it when he slows down upon seeing an officer but someone to his left speeds up and goes around him, not realizing there is someone checking speed with radar. He says the officer can't really tell which car is going that speed when they are side by side.

My husband just made it through the deferred adjudification period. Going that route did cost us less money than paying for defensive driving and didn't go on his record. Unfortunately, he got another ticket today! It's troubling to me because of what it does to our insurance rates and all the costs involved. He drives as part of his business so he's on the road quite a bit. We've never hired an attorney but I have heard that if the officer makes any little written mistake on your ticket you would have a good chance of it being dismissed.

I do happen to know someone who got a ticket when an officer went through a yellow light and she was 2 cars behind him. He pulled her over and said the light had to be red by the time she went through it. She fought it because he couldn't say he actually saw her run the red light and she won.
