My husband and I recently bought a house in Brookfield. The people who sold us our house stated that there were no water problems in the basement. 3 weeks after moving in, we got water. We haven't even made our first mortgage payment yet, and we're faced with having to have our basement torn up and drain tiles installed! We are looking for an attorney who might be able to advise us on whether we have any recourse with the sellers; and if so, handle that matter with as little cost as possible. If anyone has any great attorney referrals, we'd appreciate hearing about them!

I know you are probably not wanting to hear this but I will share my experience and I am telling you this only because I do not want you to get your hopes up and then get even more frustrated. We had the exact thing happen to us. They signed on the discosure and all the paper work that they had not water problems. The form they have is whether they have had water problems in the past 24 months or 12 months (I do not remember). There is absolutely no way to prove that they have had probs in that past period and anything you do will not help. We had a lawyer go through it and then got a second opinion from another lawyer and we could not get ANY recourse at all. You have no way of proving that the problem didn't just start or that they had flooding prior to 12 months ago. That would not give you a case. I have been through this and it sucks. We were out $10,000 even with insurance. Ours was also one month after moving into our home. Good luck with what I know is the most crappy situation ever.

The only persons's that HAVE to and should be able to help you is the attorney that represented you and your husband and your realtor. They have should still be able to help you out 60 days after your closing. Good Luck

Sorry to hear about your water issues. This happened to me and you have 1 year from the date of closing that the seller is responsible for not disclosing this information. Check the disclosure list and if they checked that there has never been water in the basement, you have a solid case. First go back to your lawyer that you hired for closing. Take pictures of the water or damage and get estimates for the repair. Good Luck@!
