After my post I didn't really get anywhere, I have a happy, beautiful 5 month old boy now and can not imagine not having him, but at the time of my post I was not happy, and thought how can this be happening if it's only 1%..... If it happened again I would really be mad... He was my 4th..
I did not go back to the IUD after getting pregnant on it. This may sound funny, but we just went back to withdrawal / calendar thing. I've been doing that since I became sexually active almost 20 years ago, and it never failed me - only had kids when we wanted.... With the IUD got pregnant after 4 months.
None of the birth control methods are effective! I have heard of people getting pregnant after vasectomy, after tubal, after every single one out there!!!! Just google "pregnant with vasectomy, pregnant after tubal" etc.
Also read reviews for each method and you'll find lots of people with side affects or horror stories...
You could try double protection, like vasectomy for your husband and something for you, that might work best. For us, we didn't want to take the risks associated with the procedures. Yes they are considered safe, but all have possible risks and we need to stay healthy to be there for our kids!. Rather then going with the risks, we're just doing it naturally, as I said that never failed me and the minute I got an official birth control method, we got pregnant, so no more of that for me. I log my periods on this site -mymonthlycycles.com and it tells me when I will be ovulating and just need to be more careful around that time....
As far as suing them - don't know. Let me know if you're successful!
Someone had suggested to file a class action suit - but I never looked into it, and with the class action - only the lawyers make money.... I know that the 1% is B.S. If you do research online, you will find A LOT of people pregnant with the IUD, so the percentage has to be less..
