We are currently renting our house that we are in. We are going to buy it towards the end of the year. When we signed the lease agreement we were never given a copy. Isn't this illegal? I am under the impression that when ever you lease something by law you have to get a copy??? If it is illegal because we don't have a copy of the lease does it void the lease agreement? We have asked SEVERAL times for a copy of the lease and have yet to receive one!

not having your copy does not negate what you signed, but you should have a copy. Try going to the rental office in person and asking for a copy, they should be able to give you one before you leave, and in the future always be sure you get your copy upon signing. It is your responsibility to be sure you have a copy, not theirs.

You have right to a copy but it does not void the terms of the lease.

I'm guessing they may have lost it.

I always ask to sign to 2 execution copies of anything, that way both parties can have an original executed copy.

It doesn't void it but if it has been lost they can't prove you signed it either...

I wouldn't say it is 'illegal' nor would I think it would make your lease voidable. I agree, that you are supposed to be given a copy (time limits vary by state), I would find out the statute for NV and maybe send a written request siting the appropriate statute. If they don't respond, contact the local housing authority for some help.

Since you're going to buy the house at the end of the year, what is the issue with not having a copy of the lease? Are you concerned that the owner won't honor the lease?

Even if it's illegal to not give you a copy the owner could tell you he gave you a copy. You must have lost it. I suggest that you take a more friendly approach when asking for a copy of the lease. If you're concerned that he won't honor the lease, be specific and write down what you remember the lease saying that is important to you and ask him to look it over, add parts he remembers and sign it.

If he has an office, go to the office and wait for a copy. If he works out of his home, perhaps he's lost it, himself.

The reason for needing a copy is what would determine how much effort I spent in getting a copy.

You can talk with a landlord/tenant office or attorney to determine your rights.

Just because you do not have a copy does not mean the lease is void, even if they have not given you one after asking time and again.

Does the lease say you are paying towards owning the house? Seems like more is going on and either you or both are trying to get out of something or away with something.

You may have to get a legal advice on how to get the lease since you need it.
