Divorce When Pregnant

Can a divorce be granted in the state of Indiana if the wife is pregnant? I've been told that it can't be and don't know why.

This is a new one for me. I didn't know that a judge could turn down a divorce request at all. But, I've never been divorced either, lol.

I'm sorry you (or a friend, you didn't specify) is going through such a difficult situation when it should be a very happy and blessed time.

If it's a simple legality thing, is a separation possible and then finalize the divorce after the birth of the baby? This might take care of the problem.

Also, I think a lot of lawyers offer free consultations. So, calling to simply ask would not cost anything.

You live in Warren Twnshp., right? So do I. If you ever want to meet somewhere for lunch or I could bring my kids over for a play date (I don't think five kids and three adults would fit in my apartment, lol) sometime, I'm game. :)

I'm not a lawyer, but I'm pretty sure you can get a divorce while pregnant in Indiana. You can file anytime, but the judge has the right to delay the divorce until after the child is born to settle any custody/legal issues with the child.

I was pregnant when my ex and I split. I had to wait until I was not pregnant to file. That is the law in the state of Indiana. A lot of people refer to them as "blue laws". Old school laws that were never changed. Good luck to you.

Nope the state of Indiana will not allow you to get a divorce while pregnant.I'm not sure as to why it can't be done.
