Baby Choked on Plastic in Her Baby Food!

So I was feeding my 9 month old baby last week her peas and she started choking on a piece of plastic that was in her baby food! I quickly gave her the infant heimlich maneuver and fished it out of her mouth with my finger. It was so scary!!! I was shaking all over and just held her until she and I both stopped crying. She is fine now, but my question is, has this happened to you or anybody you know before? Should I get a lawyer? Thanks so much for your input! **update** Sorry, forgot to tell you that we did call the company to let them know but I wanted to know if this has ever happened to anybody else.****

We are way too litiginous in this society. We need to go back to Christian principles. Your daughter is fine. It was an accident. No one intentionally put the plastic in the jar, and even if someone is out there doing that, it is not the company's fault. Let the fact that you saved your baby give you something to give thanks to God about, and let it go.

I wouldn't pursue it legally - but I would let the company know they needed to restore my confidence in the quality and safety of their product instead. Could be worth a few months of free babyfood for you.(That stuff's expensive) And then I'd strain it before use!!!

As an attorney who handles personal injury cases, I can tell you that you will probably not find an attorney who would take on this case. In order for you to get anything from the company there would have to be a serious injury and damages. Fortunately for you, your daughter was not injured, you didn't incur any medical bills, and there was negligible pain and suffering. Unfortunately being scared out of your wits is not compensable. Thank goodness your daughter is alright.

what did the company say when you called?
their response would weigh in heavily in my decision whether or not to proceed. if there was genuine alarm and concern, and some sort of an effort to make it right, that is probably enough. did they take the batch number of the baby food so they can investigate further and make sure other children aren't endangered?
if they were dismissive or offhand, i'd push it further.
may all the gods be thanked that she's okay.

I would not get a lawyer since your child is okay but I would report it to the company (as you already have), the store where you purchased it, and the Better Business Bureau.

I'm not a lawyer, so this is just my educated opinion, but a lawyer will cost you money and since there were no damages (legally) you can't recoup anything. I agree that contacting the company is the best bet, which you've done, and then you can take it from there. If they don't respond appropriately then you can contact the BBB as suggested, or even the media.

I'm sorry. That's a horrifying story. What kind of baby food was it?

I can't believe there was plastic in there!! I don't know if you could actually go through with a law suit. It will probably be really time consuming not to mention the money it will require. I found what looked like nose hair in my baby's DHA food and complained to the company. They responded a week later and sent me some coupons. I gave them the batch number and all the info I could. I was furious and from that point on just took the time to make my own baby food most of the time when we're at home.
