Oops, 1983, it was first ammended in 1995 still it was in effect in 2008.

I know that right now it is a right to cure state but was it in 2008 I can not tell what is going on in that blurb of a law. Please help!
Thank you, that is what I thought too but these EVIL NASTY SUPER FLAKEY excuses for creditors are trying to lie and tell me that they are not responsible for advising the coborrower of anything before repo and before selling etc. Basically they notified the signer but not me and now I am sitting ugly on my credit report and they are saying the "RTC law was NOT in effect in 2008" ... Any other info/help appreciated ladies love the brain trust we have!

oh, after reading your update - i dont think when this was enacted is the issue. This doesnt say what you think it says. When you sign a contract, there is a clause that says coborrower is awre of blah blah balh and that if requirements aren't met than consequences include xyz. So....you were notified at the time that you signed.

It states: 'Last modified August 11, 2007'. The first listing are citations listed to back up their argument (and references to how earlier laws worked in arguing specific cases or laws). Unless Texas law is different (which I know there are some differences in each state) it is pretty likely that the question you have is answered by when it was modified. So it was previously in existence but then modified. Oh, just saw your update. Well, addendum to mine. You signed a contract, you were a co-signer. Whenever you do that you are also responsible. BUT BUT you are right. You should have been notified. And that should be the question. Then how does the RTC law apply? AND Notify your credit report organizations THAT YOU WERE NOT NOTIFIED
